Terms and conditions

I. GENERAL PROVISIONS

  1. Hereby Conditions specify the rules of using the Internet Store  www.bizuteka.pl.
  2. Hereby Conditions are formulated according to the Art. 8 of the Act on Electronic Services.
  3. Internet Store www.bizuteka.pl is led by INC Solutions registered in Radom, POLAND. Telphone + 48 604 654 235, e-mail address: shop@bizuteka.pl

  1. Hereby Conditions specify in particular:

– the rules of registration and disposition of the account in the Internet Store;

– rules and conditions of placing Orders within the Internet Store;

– rules of entering Sales Contract using the service rendered by the Internet Store.

  1. Using the Internet Store is possible if Client’s ICT system fulfils the following technical requirements: a) Internet Explorer version MSIE 8.x or later, b) Firefox 7.x or later, c) Chrome 15.x, d) minimal resolution of the screen 1024 x 768 pixels.
  2. In order to use the Internet Store the Client should get the Access to the computer workstation or mobile device with the Internet Access and have an e-mail address.
  3. According to the current provisions of law INC Solutions limits the possibility to render services via Internet Store to individuals aged 18 or older.

Clients may obtain the access to the hereby Conditions at any time via link on the main site of www.bizuteka.pl. They may download them, as well as print them.

II.DEFINITIONS

The notions used in the Conditions mean as following:

  1. Client – a natural person, legal person or organizational unit that does not have legal entity, but is given legal capacity by certain regulations and places an order in the Internet Store:
  2. Civil Code – Act of 23 April 1964 r. (Journal of Law No. 16, item 93 with amendments);
  3. Conditions – hereby Conditions of placing orders via Internet in the Internet Store www.bizuteka.pl
  4. Internet Store (Store) – internet website at www.bizuteka.pl address via which the Client may place Orders;
  5. Goods – products presented in the Internet Store;
  6. Sales contract  – a contract for sales of Goods according to the Civil Code, concluded between INC Solutions and the Client within the Internet Store.
  7. Act of Consumers Rights – act of 30th of May 2014 r. on consumer rights (Journal of Law from  2014, item 827);
  8. Act on Rendering Electronic Services – act of 18 July 2002 on rendering electronic services (Journal of Law No. 144, item 1204 with amendments);
  9. Order – the declaration of the Client’s will, directly aiming at the conclusion of Sales contract, especially specifying the type and amount of Goods.

III. TERMS OF USE OF THE INTERNET STORE

  1. Registration in the Internet Store is optional. Client may place an order without registering in the Store, after becoming acquainted with the Conditions and accepting it.

Registration is made by filling and accepting the registration form available on the site of the Store.

In order to register in the shop it is necessary to accept the Conditions and providing personal data.

INC Solutions  may deprive the Client of the right to use the Internet Store as well as limit his access to the whole Store or its part with immediate effect if the Client violates the Conditions, especially if the Client:

– during the registration in the Internet Store has given incorrect, inaccurate or outdated personal data, which misled or violated the rights of third parties,

– via the Internet Store has violated the property of third party, especially other Clients of the Internet Store,

– undertook other actions which will be considered by INC Solutions as inconsistent with the existing law or general rules of using the Internet or detrimental to the good name of INC Solutions,

  1. In order to grant the safety of transmission of communicates and data in reference to the services rendered by the website, the Store undertakes technical and organizational measures appropriate to the degree of violation of the safety of rendered services, especially those measures which prevent from the acquisition and modification by non-authorized persons personal data sent via Internet.
  2. The Client is particularly obliged:

not to deliver or create the content prohibited by the provisions of law, such as the content which promotes violence, violates the personal property or other property of third persons or is slanderous,

to use the Internet Store in a way that does not disturb its functioning, especially by using special software or device,

not to send or place in the Internet Store unsolicited commercials (spam),

to use the Internet Store in an inoffensive way for other Clients and INC Solutions,

to use all the content placed in the Internet Store solely for personal use,

to use the Internet Store in a way that is compliant with the provisions of the law, binding on the territory of Republic of Poland, hereby Conditions as well as general rules of using the Internet.

  1. The support of the Internet Store is available for the users only on working days (from Monday until Friday), in hours 9 am – 5 pm.
  2. The Client is not allowed to resale the Goods purchased in the Store on behalf of carried by them commercial activity.
  3. The choice of ordered Goods by the Client is made by adding them to the cart. In order to make a wholesale purchase please contact shop@bizuteka.pl

IV. THE PROCEDURE OF THE SALES CONTRACT

In order to conclude the Sales Contract via the Internet Store a Client has to open the Internet site www.bizuteka.pl, choose the Goods and proceed with the following technical activities led by the communicates shown to the Client and information available on the site.

  1. The choice of the ordered Goods by the Client is made by adding them to the cart.
  2. While placing an Order –  until the Client presses the button which confirms the Order – Client has the possibility to modify the written data and the choice of Goods. In order to do that the Client has to follow instructions available on the Site.
  3. When the Client, using the Internet Store fills all the necessary data, the summary of the Order will be visible. The summary will contain information such as: the description of chosen goods and services, total price and other costs.
  4. In order to send the Order it is necessary to accept the Conditions, provide personal data marked as necessary and press the button which confirms the Order which means the Client accepted the payment for the order.
  5. Information about Goods given on the internet site of the Store concludes the offer as defined in art. 66 of the Civil Code. Sending by the Client the Order is the declaration of will to conclude the Sales Contract with INC Solutions, in accordance with the Conditions.

The Contract is considered as concluded from the moment the Client receives the e-mail message containing the confirmation of all important elements of the Order.

  1. The Sales Contract is concluded in English and consistent with the Conditions.

V. THE DELIVERY

  1. The delivery of the Goods is limited to the territory of European Union and delivered onto the address provided by the Client while placing the Order. If you would like to make an order from countries outside European Union, please contact us at shop@bizuteka.pl or call +48 604 654 235.
  2. The delivery of the ordered Goods is made via:

– Commercial Delivery Company – UPS

The costs of delivery are as follows:

On the territory of Poland:

  • Poczta Polska Economic  – 0 zł
  • Poczta Polska Priority – 0 zł
  • Paczka w Ruchu  – 0 zł
  • Commercial Delivery Company – UPS – 10 zł

 

Outside Poland:
Air mail to countries of EU via UPS delivery company – € 10

  1. Time of the delivery
    On the territory of Poland:
  • Poczta Polska Economic  – 3-5 working days
  • Poczta Polska Priority – 1-2 working days
  • Paczka w Ruchu  – 2 working days
  • Commercial Delivery Company – UPS – 1 working day

Outside Poland:

  • Air mail to the countries of EU via UPS delivery company takes up to 3-4 working days.
  1. Clients may get the access to the Conditions at any time on www.bizuteka.pl site. They can be downloaded and printed.

Preservation, protection and access to the information about Order and General Conditions (sales conditions) is made by e-mail. All previous orders can be seen on your account after logging in.

VI. PRICES AND METHODS OF PAYMENT

  1. The prices are given in Polish zloty and respectively in euro, depending on the language version chosen, contain all components, including VAT (with the information on the rate), duty and all other components.
  2. The Client has the right to fulfil the payment by:

– PayU system operated in Poland

– Credit card or registered account in PayPal system – in Poland and outside Poland

VII. THE RIGHT TO WITHDRAW FROM THE CONTRACT

Clients are granted the right to withdraw from the agreement within 14 days without giving any reason. 14 days are counted from the day the Client received the Goods or in which the third party (but not a delivery company), indicated by the Client, received the Goods.

In order to withdraw from the Contract, you must contact us: shop@bizuteka.pl (telephone: + 48 604 654 235),  about your decision on withdrawal from the Contract by means of unequivocal declaration  (for example a letter sent by mail, or e-mail).  You can use the template of withdrawal form, nevertheless it is not necessary to use this particular one. In order to preserve the term of withdrawal from the agreement it is enough to send the information concerning your right to withdraw from the Contract before the end of the term in which you have the right to withdraw from the Contract.

The results of withdrawal from the Contract

If you withdraw from the Contract you have to send the Goods back as soon as possible. We will return all payments received from you, including the costs of delivery, immediately in all cases not later than 14 days from the day that we were informed about your decision. The return of payment will be made using the same methods of payments, as were used by you in the transaction. The cost of return is paid by the Client.

The right to withdraw from the Contract by the Consumer is not applied, if:

  • the Goods are delivered in worsened condition, i.e. broken,
  • the Goods are having the usage wear-off signs

VIII. COMPLAINTS REGARDING GOODS

  1. INC SOLUTIONS as a seller is responsible to the Client, who is a consumer according to the art. 221 of the Civil Code, according to the warranty for defective products specified in the Civil Code, especially in the art. 556 and art. 556[1]-556[3] of the Civil Code.
  2. Complaints, resulting from the violation of the Client’s rights guaranteed by the law or based on hereby Conditions, should be sent to Bizuteka.pl, Słowackiego 12/21, 01-627 Warsaw, POLAND, or shop@bizuteka.pl. We pledge the right to consider each claim within 14 days. In case this is impossible, the Client will be informed when the Claim will be considered.

Health Information

Before first wearing we advise to cleanse with alcohol silver and golden elements of jewellery that have direct contact with the skin.

By accepting the terms the Client states that they are not allergic to any metals (silver and gold) and there are no medical contraindications that could have negative or harmful influence on their health concerning the particular elements of products like: coral, shell, onyx, labradorite, lapis lazuli, citrine, mountain quartz, smoky quartz, rose quartz, ruby, sapphire, malachite, amber, charoite, sunstone, tiger eye, lava, jasper, amethyst, garnet, agate, amazonite and others including any chemical substances in them.

INC Solutions shall not be liable for any allergic or any other medical reaction suffered.

In the case of any allergic reaction the Client has a right to return the product according to the appropriate regulations in the return policy.

 

IX. COMPLAINTS CONCERNING RENDERING SERVICES VIA ELECTRONIC WAY

  1. INC Solutions undertakes all necessary actions in order to ensure the correct functioning of the Store, in such a range that results from the current technical knowledge and is obliged to correct within the reasonable period all the irregularities reported by the Clients.
  2. The Client is obliged to inform INC SOLUTIONS immediately about all irregularities or interruptions in functioning of the Internet Store.
  3. All irregularities connected with the functioning of the Store may be reported by the Client in a written form to the address of the Internet Store: INC SOLUTIONS, Słowackiego 12/21 01-627 Warsaw, Poland, or via e-mail shop@bizuteka.pl.
  4. In the Claim Form the Client should give his name, address, the type and date when the irregularity connected with the functioning of the Store occurred.

5.INC Solutions  pledges the right to consider each claim in 14 days. If that will not be possible, the Client will be informed when the Claim will be considered.

 

X. FINAL PROVISIONS

  1. The settlements of possible disputes which emerge between INC Solutions and a Client, who is a consumer according to the Art. 221 of the Civil Code are subject to the competent court according to the applicable provisions of Code of Civil Procedure.
  2. Settlements of possible disputes which emerge between INC Solutions and a Client, who is not a consumer according to the Art. 221[1] o the Civil Code is subjected to the court competent for the INC Solutions headquarters.
  3. In cases that are not regulated by the hereby Conditions the provisions of Civil, provisions of the Act of Electronic services and other applicable provisions of the Polish law Code are applied.
